Lolita’s Endangered Species Act Case Dismissed

Lolita will not go to trial. The court dismissed her case on summary judgment finding that the Miami Seaquarium can only “take” Lolita in violation of the Endangered Species Act “when its conduct gravely threatens or has the potential to gravely threaten [Lolita’s] survival.” The Court noted that “efforts to improve Lolita’s less than ideal conditions can be addressed through legislation.”
